2. Explanation of Terms

Personal Data means any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

Cookies are small text files that are stored locally on the visitor's device (e.g. PC, smartphone, tablet PC) when a website is visited. They can contain various information about the device used and the usage behavior and are sent back to the web server setting the cookie for the purpose of recognizing the user and his or her settings when reconnecting.

3. IP-Adresses and Logfiles

 Every time you access our SaaS, we automatically process the following information: 

  • the IP-address of your computer or other device (e.g. tablet-PC or smartphone) and the request(s) of your browser (including dates and times)
  • the amount of data transferred, the browser type and version, the screen resolution and the operating system used.

 

The IP-address and the information on your Internet browser's enquiry(s) are technically necessary for accessing and using the website; without processing of this data, access to the Internet site cannot take place and Internet sites cannot be displayed. The IP-address will be made anonymous by shortening it or deleted after it is no longer technically necessary for accessing or using the Internet offer or for assuring website security. 

The information on the transferred data volume, the browser type and browser version, the screen resolution and the operating system used are collected and processed in order to optimize the presentation of the contents, determine system utilization and make future adjustments and improvements to the Internet presence, possibly on the basis of statistical evaluations. 

Legal Basis for the processing of the full IP-address, the information on your Internet browser's enquiry(s) and the further information mentioned above is Art. 6 (1) s. 1 lit. (f) GDPR. The legitimate interest in the processing of personal data is to technically enable you to access the website, to optimize the representation of the website’s contents and for the future improvement/optimization of the website.

5. Registration data

When registering for our SaaS for the first time, we require the following personal information:

  • Email address (user ID)
  • Password

You may also provide further optional information, namely:

  • Name
  • Company
  • Department
  • Role/Function

Subject to your prior consent, which may allow for a further use of the data, we will only use this data for performing our duties provided in the service contract between you and us regarding the use of our SaaS. Such use e.g. includes the use of your email address for resetting your password or notifying you in case of certain events. The optional information will e.g. be used to personally address you within our SaaS service or within the implemented communication. 

This processing of your personal data as required for the performance of the service contract is based on Art. 6 (1) s. 1 lit. (b) GDPR. The data will deleted upon completion of this purpose or, if statutory retention obligations are applicable, its processing will be restricted, unless any further processing is covered by a legal basis.  

 

6. Email Communication (SendGrid, Intercom)

We use the email service provider Sendgrid, Inc., 1801 California Street, Suite 500, Denver, CO 80202, USA for administering our lists of email addresses and sending emails. The servers on which SendGrid stores and processes the data (names, email addresses) are located in the USA. Sendgrid is safeguarding an adequate level of data protection through a certification under the EU US Privacy Shield

We further use the email services of the communication provider INTERCOM, Inc., 55 2nd St, 4th Fl., San Francisco, CA 94105 USA for administering our lists of email addresses and sending emails. The legal basis of our processing of your personal data in the course of email communication depends on the purpose of the communication. If not provided otherwise in this privacy policy we only contact you via email  

 

7. Usage Tracking with HEAP

Our SaaS uses Heap Analytics, a web analysis service of Heap Analytics, Inc., 116 Natoma St., San Francisco, CA 94105, USA ("Heap Analytics"). Heap Analytics uses "cookies, to analyze how users use our service. The information generated by the cookie about your use of this website (e.g. the sites you visited and links you clicked) is usually transferred to a server of Heap Analytics in the USA and stored there. We made sure that Heap Analytics only collects a pseudonymized user ID and no additional personal information (e.g. IP, browser information etc.), which could be used to identify the user. The data collected in the course of your use of our service is not merged with other data of Heap Analytics. 

Based on a data processing agreement concluded with us Heap will use this information to evaluate for us your use of the website, to compile reports on the website activities on a statistical basis. Heap is safeguarding an adequate level of data protection when processing personal data in the US by integrating the Standard Contractual Clauses provided by the European Commission in the terms of services covering the Analysis services used in our SaaS. You may obtain a copy of the respective Data Processing Addendum by contacting us.

 

When registering for our SaaS you have the possibility to voluntarily support Seerene by providing your consent that the information on your usage of our services tracked by Heap may be linked to your user account and the data stored therein for the purpose of understanding and distinguishing between individual usage scenarios and to optimize the product with regard to your individual needs. You have the right to withdraw your consent at any time with effect to the future. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal. To withdraw the consent, please navigate to the product pages for managing your user profile and execute the respective consent withdrawal workflow. You are absolutely free to give or not to give your consent, and your decision does not have any impact on the usability of Seerene products. Also without consent, you will be able to use Seerene products without restrictions.

If you did not provide your consent to support Seerene in this manner, your usage information tracked with Heap will not be linked to a specific user account and will only be stored and used in an accumulated manner for a statistical analysis of the usage of our SaaS.

The use of cookies can be prevented by changing the browser settings accordingly; cookies can also be deleted by you via your browser settings. This may have the effect that certain functionalities of the website cannot be used at all or cannot be used as comfortably as before. 

Legal Basis for the above processing of data without your consent is Art. 6 (1) s. 1 lit. (f) GDPR. The legitimate interest in the processing lies in the analysis of usage data in order to recognize and eliminate errors on the basis of these findings and to optimize the service.

Text of the declaration of consent

I hereby give consent that Seerene GmbH and its subsidiaries may track my product usage behavior when using Seerene products and link this information to my person as well as to meta information associated with my user account and to use this data exclusively for the future system development, problem analyses, trouble shooting, and the optimization of Seerene products and services. I can withdraw my consent at any time with effect for the future by executing the respective consent withdrawal workflow in the settings of my user account.

 

7. In-App Communication (Intercom)

We further use the In-App communication services of the communication provider INTERCOM, Inc., 55 2nd St, 4th Fl., San Francisco, CA 94105 USA for providing our users with the option to get directly in contact with us by way of a chat service or In-App messages. We make sure that Intercom apart from the actual communication data does not collect any additional personal information (e.g. IP, browser information etc.). 

Intercom uses cookies to identify users for future sessions and to allow for a continuation of an ongoing chat in case of an interruption of the internet connection. These cookies store a
pseudonymized user ID to allow for an identification of the prior user of the chat without identifying the actual person using the chat. The servers on which Intercom stores and processes the data are located in the USA. Intercom is safeguarding an adequate level of data protection through a certification under the EU US Privacy Shield

Intercom is processing all information provided by us in the course of the In-App communication services based on a Customer Data Processing Agreement concluded between us and Intercom. You can find more information on Intercom’s handling of personal data here

The legal basis of our processing of your personal data in the course of In-App communication depends on the purpose of the communication. If not provided otherwise in this privacy policy we only contact you by way of In-App communication in order to provide you with support or where necessary for the workflows of our service (e.g. alert notices, notices on planned service maintenance times, etc.) based on Art. 6 (1) s. 1 lit. (b) GDPR.

 

9. Customer Support (Zendesk)

We use the Zendesk ticketing system, a customer service platform of Zendesk Inc, 989 Market Street #300, San Francisco, CA 94102, to process customer inquiries. In the course of processing customer inquiries Zendesk is provided with the necessary information such as last name, first name and e-mail address via our website in order to respond to your inquiry. The servers on which Zendesk stores and processes the data are located in the USA. Zendesk is safeguarding an adequate level of data protection through a certification under the EU US Privacy Shield

Our processing of your personal data in the course of your inquiries regarding our services is necessary for the performance of our services and is based on Art. 6 (1) s. 1 lit. (b) GDPR.

 

10. Recipients of Personal Data 

We have concluded contracts with third-parties that are processing personal data on our behalf as processors according to Art. 28 GDPR, which are recipients of personal data according to Art. 4 No. 8 GDPR):

11. Your Rights

The GDPR provides you with the following rights:

  • You have the right to obtain from us confirmation as to whether or not personal data concerning you are being processed, and, where that is the case, access to the personal data and the information specified in Art. 15 (1) GDPR, unless there are no legal exceptions limiting this right.
  • You have the right to rectification of inaccurate personal data concerning you and, taking into account the purposes of the processing, to have incomplete personal data completed (Art. 16 GDPR).
  • Where one of the grounds set forth in Art. 17 (1) GDPR applies, you have the right to obtain from us the erasure of personal data concerning you, unless none of the exceptions specified in Art. 17 (3) GDPR applies.
  • In the cases which are set forth in Art. 18 (1) GDPR, you have a right to obtain from us the restriction of processing, and where Art. 20 Abs. 1 GDPR applies, a right to data portability.
  • You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you which is based Art. 6 (1) s. 1 lit (f) or (e) GDPR, unless the we demonstrate compelling legitimate grounds for the processing which override the your interests, rights and freedoms or for the establishment, exercise or defense of legal claims.
  • Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement if you consider that the processing of personal data relating you infringes this Regulation
